Terms of Service
These Terms of Service ("Terms") govern your access to and use of the MyMemoriAI website, applications, APIs, and related services (collectively, the "Service", "MyMemoriAI," "we," "us," or "our").

By accessing or using the Service, creating an account, clicking to accept these Terms, purchasing credits, uploading content, or generating output through the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and "you" will refer to both you and that entity.
1. The Service
MyMemoriAI is an AI-powered image-to-video generation platform that allows users to upload images and related prompts, request video generations, store or access generated results, and manage usage through a credit-based system.
The Service may include experimental, automated, or machine-learning features. Output generated by artificial intelligence may be unpredictable, incomplete, inaccurate, stylistically inconsistent, offensive, or unsuitable for your intended purpose. The Service is provided for lawful purposes only and is subject to availability, technical limitations, and these Terms.
We may modify, suspend, discontinue, improve, replace, or impose limits on any part of the Service at any time, with or without notice, to the fullest extent permitted by law.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your place of residence, whichever is higher, to use the Service. If you are under that age, you may not use the Service.
You represent and warrant that:
- you have legal capacity to enter into these Terms;
- all information you provide is accurate and complete;
- your use of the Service does not violate any applicable law, regulation, court order, contractual restriction, or third-party right.
3. Account Registration and Security
To use all features of our Service, you are required to create an account or authenticate using a third-party identity provider such as Google.
You agree to:
- promptly notify us of any suspected unauthorized access or security incident involving your account;
- be responsible for all activity that occurs under your account, whether or not authorized by you, unless such responsibility cannot be imposed under applicable law.
We may reject, suspend, reclaim, or terminate accounts that are inactive, fraudulent, abusive, misleading, duplicative, created through bots, or otherwise used in violation of these Terms.
4. Acceptable Use
You may use the Service only in compliance with these Terms and applicable law. You must not, and must not attempt to, use the Service to:
- upload, generate, distribute, or facilitate illegal content or conduct;
- infringe or misappropriate copyrights, trademarks, patents, trade secrets, database rights, moral rights, privacy rights, publicity rights, portrait rights, image rights, or any other rights;
- create content that is defamatory, fraudulent, deceptive, misleading, harassing, threatening, hateful, extremist, exploitative, or abusive;
- generate sexually explicit or exploitative content, including any content involving minors or any age-inappropriate depiction of minors;
- impersonate another person, misrepresent origin, identity, endorsement, or affiliation, or create false evidence or synthetic media intended to deceive in harmful or unlawful ways;
- upload images of people without all necessary permissions, including consent required by privacy, publicity, biometric, data protection, employment, or personality-rights laws;
- process special categories of personal data, biometric data, or sensitive content without a valid legal basis and all required consents;
- use the Service for stalking, doxxing, blackmail, extortion, intimidation, non-consensual intimate imagery, revenge content, or targeted harassment;
- use the Service to create political misinformation, election disinformation, forged journalism, fabricated evidence, or deceptive deepfakes;
- upload malware, malicious code, scripts, bots, spyware, or other harmful components;
- interfere with, disrupt, reverse engineer, probe, scrape, overload, bypass, or attempt to gain unauthorized access to the Service or related systems;
- circumvent usage limits, safety features, payment controls, account restrictions, or content moderation systems;
- use automated methods to access the Service except through officially supported interfaces expressly authorized by us;
- use the Service in a way that creates unreasonable load, security risk, reputational harm, or legal exposure for us or others.
We may determine, in our sole discretion, whether content or conduct violates these Terms.
5. User Content
"User Content" means any data, images, text, prompts, metadata, instructions, audio, video, likenesses, names, faces, voices, branding, or other materials that you upload, submit, post, store, transmit, or otherwise make available through the Service, including materials included in generation requests.
You retain ownership of User Content as between you and MyMemoriAI. However, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, modify, transmit, display, and use User Content solely as necessary to: provide, maintain, and improve the Service; generate requested output; detect, prevent, investigate, and enforce against fraud, abuse, security issues, and policy violations; comply with legal obligations and law-enforcement requests; protect our rights, users, systems, personnel, and the public.
You represent and warrant that, for all User Content and all uses you make through the Service: you own or control all necessary rights, licenses, consents, permissions, and legal bases; you have obtained all required permissions from every identifiable person shown, heard, or referenced; your User Content and its use through the Service do not violate any law or third-party rights; you will maintain records of any necessary consents and permissions and provide them upon request if reasonably required for compliance, moderation, or dispute handling.
6. Facial Images, Likenesses, and Sensitive Material
Because the Service may transform personal images into synthetic video output, you acknowledge and agree that additional legal obligations may apply when images contain identifiable persons, especially faces, children, employees, customers, public figures, or any sensitive context.
You must not upload any image containing a person unless you have all rights and permissions necessary for: uploading and processing the image; generating synthetic or AI-modified output from that image; storing the image and output as needed for the Service; using, publishing, sharing, or commercializing the resulting output.
If you upload images of another person, you represent and warrant that the person has provided all legally required consent for that use. If local law requires written consent, you are responsible for obtaining and retaining it.
You are solely responsible for determining whether an image contains biometric or other regulated personal data and whether your use of the Service is permitted.
7. Prohibited Content Categories
Without limiting Section 4, the following content is strictly prohibited:
- child sexual abuse material or any sexualized content involving minors;
- non-consensual intimate imagery;
- exploitative, predatory, or grooming-related content;
- violent extremism or terrorist propaganda;
- content that promotes self-harm, suicide, or eating disorders;
- forged government IDs, certificates, records, or legal documents;
- fraud materials, scams, impersonation assets, counterfeit marketing, or fabricated evidence;
- medical, legal, insurance, employment, or financial deception content intended to mislead;
- content that violates sanctions, export controls, or criminal law.
We may report illegal content to relevant authorities where required or permitted by law.
8. AI Generation; No Guarantee of Accuracy or Suitability
The Service uses machine-learning systems and related infrastructure. Generated content may not be accurate, stable, unique, or fit for any specific purpose. Similar or identical output may be generated for other users. Output may contain artifacts, distortions, factual errors, style inconsistencies, or unexpected elements.
You acknowledge that:
- AI output is probabilistic and may vary from request to request;
- output may resemble existing works, people, brands, or content;
- we do not guarantee uniqueness, originality, non-infringement, merchantability, fitness for a particular purpose, or commercial suitability of any output;
- you are solely responsible for reviewing and validating output before relying on, publishing, distributing, or commercializing it.
9. Output Rights and Responsibility
"Output" means content generated by the Service in response to your input.
Subject to your compliance with these Terms and payment of applicable fees, and as between you and MyMemoriAI, we assign to you or grant you a license to use the Output generated from your lawful requests to the extent of our rights, if any, in that Output.
This does not mean:
- that the Output is exclusive to you;
- that the Output is copyrightable in every jurisdiction;
- that the Output is free from third-party claims;
- that you may use the Output in violation of law, rights, platform rules, or these Terms.
You are solely responsible for all downstream use of Output, including publication, licensing, distribution, advertising, commercialization, labeling, and legal compliance.
10. Synthetic Content Disclosure
You acknowledge that certain laws may require disclosure that content was generated, altered, or enhanced using AI, especially where the content depicts real persons, realistic scenes, or potentially misleading synthetic media.
You agree that you will provide all notices, labels, disclosures, watermarks, metadata, or context required by applicable law or platform rules when publishing or distributing Output. We may add or preserve labels, metadata, or notices indicating AI generation or modification, and you may not remove or circumvent such disclosures where prohibited by law or our technical controls.
11. Moderation, Monitoring, and Enforcement
We are not obligated to monitor all content, but we may review, screen, filter, block, remove, restrict, investigate, preserve, or disclose content or account data where we reasonably believe it is necessary to: operate, secure, or improve the Service; enforce these Terms; investigate fraud, abuse, or infringement; comply with law, regulation, court order, subpoena, or governmental request; protect us, our users, third parties, or the public.
We may remove content or suspend access without prior notice where necessary for safety, legal compliance, security, or abuse prevention.
Where required by applicable law, we may provide notice of moderation decisions and applicable complaint or appeal channels.
12. Intellectual Property Complaints
If you believe content available through the Service infringes your intellectual property or other rights, you may send a notice to info.mymemoriai@gmail.com with sufficient detail to identify: the allegedly infringing content; the rights claimed; your authority to act; supporting evidence; your contact information; a statement made in good faith that your claim is accurate.
We may remove or disable content while investigating and may share the complaint with the affected user where appropriate and lawful. We may terminate repeat infringers.
13. Credits, Pricing, Billing, and Taxes
The Service may operate on a prepaid credit system. Credits may be required to submit generation requests or use premium features.
You agree that:
- prices, packages, and credit values may change at any time before purchase;
- you are responsible for all applicable taxes, duties, levies, exchange fees, and bank or payment-provider charges;
- credits have no cash value except where required by law;
- credits are non-transferable, non-resellable, and may not be redeemed for money;
- unused credits may expire only if expressly disclosed at purchase and permitted by law;
- abusive refund requests, payment reversals, or chargebacks may result in suspension or termination.
We may use third-party payment processors. Your payment may be subject to their terms and privacy practices.
14. Credit Consumption Rules
Credits are consumed when a generation request is submitted, accepted into processing, or otherwise reserved by the Service according to the usage rules displayed at checkout or in-product.
Unless otherwise stated:
- a generation attempt may consume credits even if the result is unsatisfactory, because compute resources are used;
- generations blocked for policy reasons may or may not consume credits depending on system design and abuse controls;
- generations that fail solely due to a verified internal technical error may be eligible for re-credit or refund at our discretion or where required by law.
Our logs and internal records will be the authoritative basis for determining whether credits were consumed, except where such records are demonstrably incorrect.
15. Refunds
To the fullest extent permitted by law, purchases of credits, subscriptions, and related digital services are final and non-refundable once the digital service has begun, the credits have been granted, or compute resources have been allocated.
Notwithstanding the foregoing, we may, in our sole discretion, issue refunds, credits, or replacements in cases of duplicate payment, billing error, or confirmed technical failure attributable solely to us.
Nothing in these Terms limits mandatory consumer rights that cannot be waived under applicable law.
16. Subscriptions
If we offer subscriptions, the subscription will automatically renew for the stated billing period unless canceled before renewal.
By purchasing a subscription, you authorize recurring charges to your chosen payment method. Subscription benefits, included credits, rollover rules, and renewal terms will be described at checkout or in your account settings.
We may change subscription pricing prospectively on notice. Continued use after the effective date of the new pricing constitutes acceptance unless you cancel before renewal.
17. Storage and Retention
We do not guarantee permanent storage, backup, retrieval, archiving, or continued availability of User Content or Output. You are solely responsible for maintaining your own backups.
We may delete or anonymize content, account data, outputs, or logs: after defined retention periods; after account closure; when storage limits are exceeded; where required for security, moderation, or legal reasons; where retention is no longer necessary for the purposes for which data was processed.
Temporary processing copies, cache files, and backup remnants may persist for a limited time.
18. Privacy and Data Protection
Our processing of personal data is governed by our Privacy Policy.
Depending on the nature of the Service and the role each party plays, we may act as an independent controller, joint controller, or processor with respect to certain personal data processing activities. Where legally required, separate data-processing terms may apply. Under GDPR, controllers must ensure processors provide sufficient guarantees regarding technical and organizational measures.
You are solely responsible for ensuring that your upload and use of personal data through the Service is lawful, transparent, and supported by an appropriate legal basis.
19. Third-Party Providers
The Service may rely on third-party providers, including cloud hosting providers, authentication providers, payment processors, AI model providers, analytics services, content delivery networks, moderation vendors, or storage services.
We are not responsible for failures caused by third-party providers, internet infrastructure, force majeure events, or matters outside our reasonable control.
Third-party services may be governed by separate terms and policies, and your use of those third-party services may be subject to those terms.
20. Availability, Maintenance, and Beta Features
The Service is provided on an "as is" and "as available" basis.
We do not guarantee that the Service will be uninterrupted, secure, error-free, virus-free, or compatible with every device, browser, or workflow. Planned or emergency maintenance, software issues, vendor outages, model changes, content filtering, or infrastructure failures may affect availability or output quality.
Features labeled "beta," "preview," "experimental," or similar are offered for evaluation only and may be incomplete, unstable, or withdrawn at any time.
21. Suspension and Termination
We may immediately suspend, limit, disable, or terminate your access to the Service, without prior notice, if: you breach these Terms; we suspect fraud, abuse, infringement, illegal activity, or security risk; your use creates legal exposure, technical harm, or reputational risk; we receive a legal demand or complaint concerning your activity; payment fails or is reversed; continued service is impracticable or unlawful.
You may stop using the Service at any time. Termination does not entitle you to refunds except where required by law.
Upon termination, rights granted to you under these Terms cease immediately, but provisions that by nature should survive termination will survive, including provisions on ownership, payment, disclaimers, liability limitations, indemnity, dispute resolution, and enforcement.
22. Disclaimers
To the fullest extent permitted by law, the Service, all output, and all related content are provided "as is," "as available," and without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, non-infringement, availability, security, accuracy, reliability, quality, compatibility, or that defects will be corrected.
We do not warrant that:
- the Service will meet your requirements or expectations;
- any output will be accurate, lawful, original, or commercially valuable;
- any output will not infringe or allegedly infringe third-party rights;
- stored content will never be lost, corrupted, or accessed by unauthorized persons;
- the Service will always be available or free from interruption.
Nothing in these Terms excludes warranties that cannot legally be excluded.
23. Limitation of Liability
To the fullest extent permitted by law: MyMemoriAI and its owners, directors, officers, employees, contractors, affiliates, licensors, suppliers, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; this exclusion includes loss of profits, revenue, business, goodwill, reputation, data, use, anticipated savings, opportunities, contracts, or claims by third parties; we shall not be liable for any damages arising from user content, output, platform misuse, infringement claims, failed expectations, moderation actions, downtime, deletion, storage loss, security incidents, third-party services, or unauthorized access, except to the extent caused by our gross negligence or willful misconduct where such exclusion is not legally permitted; our aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim; or (b) EUR 100.
This limitation applies regardless of the form of action and even if a remedy fails of its essential purpose.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including where applicable liability for fraud, willful misconduct, or death or personal injury caused by negligence. Broad exclusions that create unfair imbalance in consumer contracts may be unenforceable.
24. Indemnification
You agree to defend, indemnify, and hold harmless MyMemoriAI and its owners, directors, officers, employees, affiliates, contractors, licensors, suppliers, and service providers from and against any and all claims, demands, complaints, investigations, proceedings, damages, judgments, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to: your User Content; your Output or downstream use of Output; your breach of these Terms; your infringement or violation of any law or third-party rights; your misuse of the Service; any claim that you lacked required permissions, consents, licenses, or legal basis for uploaded content or generated content.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate fully.
25. No Fiduciary Duty; No Professional Advice
The Service is a technology tool. We are not your attorney, agent, fiduciary, insurer, archivist, publisher, editor, employer, advisor, or representative. We do not provide legal, medical, psychological, accounting, insurance, or professional advice through the Service.
26. Compliance With Law
You are solely responsible for complying with all laws applicable to your use of the Service and your content, including laws relating to: intellectual property; privacy and data protection; image rights, likeness rights, and publicity rights; biometric and facial data; consumer protection; advertising disclosures; election integrity and media laws; employment and workplace consent; child protection; criminal law, sanctions, and export controls.
If you use the Service in regulated sectors or for commercial publication, you are responsible for obtaining legal advice appropriate to your use case.
27. Notice-and-Action; Illegal Content
If the Service qualifies as a hosting or intermediary service in applicable jurisdictions, we may provide notice-and-action mechanisms for reporting allegedly illegal content. We may act on such notices and may remove or disable access to content where necessary or appropriate. Hosting-related liability protections in the EU are conditional and generally depend on acting in a neutral role and responding appropriately once aware of illegal content.
28. Force Majeure
We are not liable for any delay, interruption, failure, or non-performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, government action, power failures, internet outages, cyberattacks, vendor failures, model-provider shutdowns, hosting failures, or shortages of materials or services.
29. Changes to the Service or Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. If required by law, we will provide additional notice for material changes.
By continuing to use the Service after updated Terms become effective, you agree to the updated Terms. If you do not agree, you must stop using the Service.
30. Governing Law
These Terms and any non-contractual disputes arising out of or in connection with them are governed by the laws of Belgium, excluding conflict-of-law principles, unless mandatory local consumer law requires otherwise.
31. Assignment
You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, to any affiliate, successor, purchaser, or in connection with a merger, acquisition, reorganization, or sale of assets.
32. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and MyMemoriAI regarding the Service and supersede prior or contemporaneous understandings relating to the same subject matter.
33. Severability
If any provision of these Terms is found invalid, illegal, void, or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect.
34. Waiver
No waiver of any provision of these Terms will be deemed a further or continuing waiver of that or any other provision, and our failure to enforce any right or provision does not constitute a waiver.
